He closes parliament. He bans newspapers. He fills prisons with opponents and streets with soldiers.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Maurice Joly imagined something more sophisticated.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In <em>The Dialogue in Hell Between Machiavelli and Montesquieu<\/em>, published in 1864 as a satire of political despotism and, more specifically, of Napoleon III\u2019s regime, Joly asks what would happen if authoritarian power learned from constitutional government rather than merely attacking it.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">His answer is the unsettling heart of the book: <strong>the most effective modern despot may not abolish liberty\u2019s institutions at all. He may keep them, praise them\u2014and quietly change what they are capable of doing.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That idea gives Joly\u2019s strange dialogue between two dead political philosophers much of its enduring intellectual force.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Here are seven of its most striking insights.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>1. Modern tyranny may preserve the constitution rather than destroy it<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Montesquieu believes modern political civilization has made classical despotism increasingly difficult.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Constitutions divide powers. Legislatures represent citizens. Courts provide guarantees. Public opinion restrains rulers. Political rights have acquired institutional form.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Joly\u2019s Machiavelli accepts almost the entire description.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">He simply draws the opposite conclusion.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Why destroy institutions that can be repurposed?<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A legislature may remain while losing meaningful initiative. A senate may remain while interpreting constitutional ambiguities in the executive\u2019s favor. Courts may continue operating while appointments and procedures make their independence increasingly formal.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The decisive principle appears in Machiavelli\u2019s observation:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cA small number of combinations, skillfully arranged, are enough to change completely the operation of powers.\u201d<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">This is Joly\u2019s great conceptual reversal.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Political liberty cannot be measured merely by asking whether an institution exists.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A parliament can exist.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A court can exist.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A constitution can exist.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The real question is what each is still able to do.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The difference between appearance and capacity becomes the central problem of modern power.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>2. To understand power, look at verbs rather than nouns<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Joly\u2019s argument encourages an unusually practical way of reading political institutions.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Do not stop at words such as <em>constitution<\/em>, <em>parliament<\/em>, <em>court<\/em>, <em>election<\/em>, or <em>press<\/em>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Ask instead:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Who proposes?<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Who appoints?<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Who interprets?<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Who controls procedure?<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Who decides exceptions?<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Who possesses the final initiative?<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Machiavelli repeatedly discovers that seemingly minor procedural powers can matter more than magnificent constitutional declarations.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A government does not necessarily need to announce that the legislature is powerless. It can control which proposals reach it.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It need not declare the constitution meaningless. It can reserve sufficiently broad powers of interpretation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It need not openly eliminate judicial safeguards. It can alter jurisdiction, appointment, procedure, or the machinery through which politically sensitive cases are handled.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This is why Joly\u2019s political imagination feels so modern.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">He is interested less in institutional names than in <strong>institutional mechanics<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Constitutional language describes a building.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Joly wants to know who holds the keys.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>3. Elections can survive even when meaningful political choice becomes weaker<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">One might expect Joly\u2019s Machiavelli to fear universal suffrage.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">He does not.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">He wants it.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cThe popular vote, which I have made the instrument of my power, will become the very foundation of my government.\u201d<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">The paradox is essential.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A vote can restrain political authority\u2014but it can also certify it.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Machiavelli therefore imagines a system in which suffrage remains formally broad while the circumstances surrounding political choice are carefully managed.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The constitution is presented to the electorate as a whole rather than subjected to genuine deliberation. Electoral meetings can be restricted. Government-supported candidates can benefit from administrative influence. Opposition can remain technically possible while operating under structural disadvantages.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The objective is not necessarily to abolish voting.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It is to shape the environment in which voting occurs.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This distinction matters because it separates <strong>the existence of an electoral procedure from the political conditions that give the procedure substance<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Joly\u2019s satire therefore asks a harder question than \u201cWere votes cast?\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It asks whether citizens could organize, deliberate, obtain information, compare alternatives, and challenge the authority presenting itself for ratification.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">An election is an event.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Political freedom is the system surrounding it.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>4. The cleverest censorship may be more speech, not less<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Joly\u2019s treatment of the press is perhaps the most startling part of the book.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">At first Machiavelli proposes familiar restrictions: authorization requirements, taxes, financial guarantees, administrative penalties, and legal responsibility for publishers and printers.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Then he announces that these measures are merely defensive.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The real innovation comes next.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cSince journalism is so great a force, do you know what my government would do? It would itself become a journalist.\u201d<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">And then the extraordinary phrase:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cIt would be journalism incarnate.\u201d<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">The government will not merely suppress hostile information.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It will enter the information system.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It can support publications representing different shades of opinion. It can influence supposedly independent voices. It can permit limited criticism. It can release arguments indirectly, contradict itself strategically, test reactions, and surround genuine opposition with a flood of managed political language.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The goal is subtler than universal belief.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Citizens do not necessarily have to believe the same thing.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">They may simply become unable to tell where political messages originate.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Confusion can accomplish what censorship cannot.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">So can exhaustion.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">So can contradiction.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">So can the multiplication of voices until distinguishing spontaneous opinion from manufactured opinion becomes unusually difficult.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Joly\u2019s modern despot does not merely silence the public sphere.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">He competes to occupy it.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>5. Financial administration can become political power<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Joly understands something easily overlooked in political satire: domination is not built from police and censorship alone.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Budgets matter.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Debt matters.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Credit matters.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Public employment matters.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Public works matter.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Accounting procedures matter.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In the later dialogues, financial administration becomes part of the architecture of power.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Machiavelli recognizes that budgetary rules can constrain governments\u2014but he also sees how presentation can obscure substance.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cWhen facts are skillfully presented, many things are overlooked.\u201d<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">Even financial transparency can become rhetorical material. Official reports may endlessly proclaim clarity, accountability, regularity, and control while the practical distribution of decision-making authority shifts elsewhere.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">More broadly, Joly sees how economic dependence can reinforce political stability.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A citizen may be connected to the state through employment, contracts, investments, pensions, public debt, or projects whose continuation depends upon existing political arrangements.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This produces a form of power quite different from simple terror.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The citizen need not fear only the policeman.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">He may fear losing a salary.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A contract.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">An investment.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A position.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">An expectation of prosperity.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Power becomes stronger when political disruption also becomes personally expensive.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>6. Surveillance becomes most powerful when suspicion spreads through society itself<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Joly\u2019s Machiavelli also develops a system of political surveillance.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Correspondence can be intercepted.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Opposition circles can be infiltrated.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Informers can exist throughout society.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Private gatherings can contain unseen listeners.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But Joly goes further into darker territory: Machiavelli even discusses <strong>simulated conspiracies<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Such a manufactured threat could increase sympathy for the ruler, justify stronger measures, and create opportunities for investigation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The important idea is not simply that the state watches society.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It is that surveillance can alter society\u2019s internal relationships.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If anyone might be reporting what is said, trust itself becomes politically consequential.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Machiavelli describes a police apparatus scattered:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cthrough every rank of society.\u201d<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">Power has then accomplished something more effective than observing individuals.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It has inserted uncertainty into ordinary association.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Joly\u2019s political world repeatedly works this way.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The most sophisticated techniques do not merely prohibit behavior.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">They change the conditions under which people decide whether to speak, organize, trust, or resist.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>7. The book\u2019s terrible afterlife shows the difference between political analysis and conspiracy theory<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">No discussion of Joly\u2019s book can ignore what happened to it later.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Large portions of <em>The Dialogue in Hell<\/em> were plagiarized and transformed into <em>The Protocols of the Elders of Zion<\/em>, the notorious antisemitic forgery that falsely purported to reveal a Jewish conspiracy for global domination. The edition emphasizes that Joly\u2019s original text contains no Jewish conspiracy, no \u201cElders of Zion,\u201d and no racial or religious group secretly controlling world affairs.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The transformation is intellectually revealing.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Joly had invented an authoritarian speaker explaining <strong>how<\/strong> modern institutions might be manipulated.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The forgery invented <strong>who<\/strong> was supposedly doing the manipulating.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That single substitution changes everything.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Political analysis examines mechanisms: institutions, incentives, appointments, procedures, finance, administrative influence, and concentrations of authority.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Conspiracy theory replaces that complexity with an imaginary hidden actor.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Joly asks:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>How can visible institutions conceal shifts in actual political power?<\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The conspiracy theorist asks:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>Who secretly controls everything?<\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Those are radically different questions.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The distinction is especially important because Joly deliberately gives tyranny an intelligent voice. His Machiavelli speaks systematically. He says, in effect: <em>I shall do this; I shall arrange that; I shall retain this institution while changing its function.<\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Remove Montesquieu.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Remove the irony.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Remove Napoleon III.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Remove the fictional framework.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Change \u201cI\u201d into \u201cwe.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The satire can suddenly be falsified into something resembling a conspiratorial confession.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That is essentially what happened.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Joly wrote fiction in order to reveal political mechanisms.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The later forgery reused that fiction in order to fabricate an enemy.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<p class=\"wp-block-paragraph\">This is why <em>The Dialogue in Hell<\/em> remains such an intellectually unsettling book.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Its deepest insight is not that governments can lie.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Nor is it simply that rulers seek more power.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Political literature had known both propositions for centuries.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Joly\u2019s innovation is to imagine what happens when concentrated power becomes sophisticated enough to understand the institutions designed to restrain it.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The crude despot attacks constitutional government from outside.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Joly\u2019s modern despot enters it.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">He learns its language.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">He preserves its ceremonies.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">He invokes popular sovereignty.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">He retains elections.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">He issues reports.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">He speaks respectfully of law.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">He surrounds himself with constitutional forms.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">And then he asks, institution by institution, what must be altered so that the form survives while independent power disappears.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Montesquieu\u2019s answer remains the moral center of the dialogue. Liberty does not consist merely in possessing political institutions.
